Heard learned counsel for the petitioner and learned Standing Counsel for the State.

This writ petition has been filed with the following prayer:-

"I. issue a writ, order or direction in the nature of mandamus commanding the respondent no.2 (Collector, Azamgarh) to ensure the hearing of Case No.2229/2014 Computerized Case No.D20141506002229 Bhola Nath Vs. Adhyaksha Bhumi Prabandhak Samiti filed u/s 198 (4) U.P.Z.A. and L.R. Act, 1950 and decide the same within stipulated time which this Hon'ble Court may fixed."

It is contended that petitioner is complainant and he has filed case under Section 198(4) of U.P.Z.A. and L.R. Act, 1950 which is pending consideration before respondent no. 2.

As no useful purpose would be served in keeping the matter pending, the matter is being disposed of at this stage without calling for counter affidavit or issuing notice to private respondents, with a direction upon respondent no. 2 to decide Case No.2229/2014 Computerized Case No.D20141506002229 Bhola Nath Vs. Adhyaksha Bhumi Prabandhak Samiti, if there are no legal impediments and after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of six months from the date of production of certified copy of this order.

With the aforesaid directions, writ petition stands disposed of.

It is made clear that the Court has not adjudicated upon the merits of the case.
