Heard learned counsel for the petitioner and learned Standing Counsel for the State.

This writ petition has been filed with the following prayer:

"Issue a writ, order or direction in the nature of Mandamus commanding/directing the Sub Divisional Magistrate, Tehsil-Khadda, District Kushinagar (respondent no.2) to decide the case no.T202105440 501414 (Santari Devi Vs. Radheshyam and others) under Section 134 U.P. Revenue Code, 2006 dated 13.12.2019 within stipulated period as this Hon'ble Court may be directed."

It is contended by counsel for the petitioner that an application under Section 134 of U.P. Revenue Code, 2006 pending since 13.12.2019.

As no useful purpose would be served in keeping the matter pending or calling for counter affidavit or issuing notice to the private respondents No.3 to 5, with the consent of counsel for the parties, the writ petition is disposed of , at the admission stage, with a direction upon respondent no. 2 to take decision on the application of petitioner, strictly in accordance with law, expeditiously, preferably within a period of three months from the date of production of certified copy of this order.

It is made clear that this Court has not adjudicated the matter on merits.
