The writ petition has been filed with the following prayer:

"(A)- Issue a writ, order or direction in the nature of Certiorari quashing the impugned order dated 04.05.2011 passed by Commissioner (Food) Moradabad Region Moradabad (Respondent no.2) and Impugned order dated 20.06.2009 passed by District Supply Officer Rampur (Respondent no.4).

(B)- Issue a writ, order or direction in the nature of mandamus commanding the respondent authorities to restore the fair price shop license of petitioner."

It is submitted by learned counsel for the petitioner that fair price shop of the petitioner was cancelled on the ground of pendency of criminal proceedings and now the acquittal order has been passed in respect of petitioner. Learned counsel for the petitioner submits that representation given to the authority concerned is not traceable and the petitioner may be permitted to file fresh representation bringing the authority concerned to subsequent developments arising out of acquittal of the petitioner.

Learned Standing Counsel has no objection.

In view of aforesaid, the writ petition is disposed of with liberty to file representation before District Supply Officer, Rampur in respect of subsequent developments arising out of acquittal. In the event any such representation is filed within 30 days from today, the same shall be considered and decided by the authority concerned within two months from the date of production of a certified copy of this order. The impugned orders dated 4.5.2011 and 20.6.2009, shall be subjected to fresh decision by the District Supply Officer.
