Heard Shri Shailendra Kumar Mishra, learned counsel for petitioner, learned Standing Counsel for the State and perused the material available on record.

It has been submitted by learned counsel for the petitioner that the petitioner is the owner of the Dev pathology & Ultrasound Clinic, in District Banda and is duly registered under the Pre-Conception and Pre-Natal Diagnostic Techniques Act, 1994.

It is stated that certain complaints were made received against the petitioner wherein one patient had died for which the petitioner was held to be guilty and his registration was cancelled by means of order dated 17.11.2023 passed by the District Magistrate. The petitioner had filed an appeal under Section 19 (3) of the Pre-Conception and Pre-Natal Diagnostic Techniques Rules, 1996 on 28.11.2023 and according to Section 19 (2) of the Rules of 1996, the same was to be decided within a period of 60 days but submits that till date, the said appeal has not been decided and is still pending.

This Court had directed the learned Standing Counsel to inform this Court as to within what period, the said appeal could be decided. It has been informed that the case is listed for

12.04.2024 for the response of Chief Medical Officer, Banda and submits that the appeal shall be decided expeditiously within the period prescribed.

In light of the aforesaid statement of learned Standing Counsel, this writ petition is disposed of with the direction to the appropriate authority/ State Appellate Authority to consider and decide the appeal of the petitioner within two months from the date of certified copy of the order is produced before him by a reasoned and speaking order in accordance with law, if there is no legal impediment. The petitioner shall cooperate in the proceedings before the appellate authority and shall not seek any unnecessary adjournment.

With the aforesaid observations/directions, this petition is disposed of.
