Heard learned counsel for the petitioner, learned counsel for the State as also Sri Dilip Kumar Pandey, learned counsel for the Gaon Sabha concerned.

In view of order proposed to be passed, issuance of notice to the private-respondents is hereby dispensed with.

Present petition has been filed for the following main relief:-

"Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties to comply order dated 05.06.2015 passed by the Aper Collector Hardoi / opposite party no. 2 in respect of Case No. D2012103300283 (State Versus Subedar) and evict the opposite party no. 5 from the land of Gata No. 1852 /0.443 hectare out of which 130 sq. meter situate at Village Fatiyapur, Pargana Bangar, Tehsil and District Hardoi as contained in ANNEXURE No. 1 to this writ petition."

Learned counsel for the State, based upon the instructions dated 06.03.2024, a copy of which is taken on record, submitted that after considering the entire facts of the case as also the order dated 07.07.2023 passed by the revisional authority, affirming the order dated 05.06.2015, the proceedings under Section 67 of the U.P. Revenue Code, 2006 (in short "Code of 2006") have been initiated and the same would be concluded by the authority concerned within the statutory time limit i.e. 90 days, if there is no legal impediment in this regard.

In view of aforesaid, this Court is of the view that no fruitful purpose will be served in keeping this petition pending.

Accordingly, this petition is disposed of with a direction to the Court/Authority concerned to conclude the proceedings instituted under Section 67 of the Code of 2006, expeditiously, in term of statutory provisions and the law in this regard.

With the aforesaid, petition is disposed of.
