Heard learned counsel for the petitioner. Notice on behalf of the respondent No.1 has been accepted by the office of the Chief Standing Counsel.

The submission of the learned counsel for the petitioner is that a time barred appeal was preferred by the private-respondents against an order of mutation. The said appeal was not accompanied by an application seeking condonation of delay, yet the appeal was entertained and an interim order has also been granted.

The record indicates that the petitioner had filed his objections before the appellate authority on 25.10.2023, however, no such ground has been raised, however, considering the issue raised by the learned counsel for the petitioner, it will be necessary to hear the private-respondents No.2 and 3.

Accordingly, let notice be issued to the respondents No.2 and 3.

Learned counsel for the petitioner shall take steps within a week from today.
