Heard learned counsel for the petitioner and Shri Rahul Shukla, learned Additional Chief Standing Counsel appearing for the respondents no. 1 to 3.
No notice be issued to respondents no. 4 and 5 taking into consideration the nature of order proposed to be passed.
The instant writ petition has been filed praying for a writ of mandamus commanding the respondents to remove the encroachment over the public nali over the land bearing Gata No. 1051 situated in Village Mirpur Saroyia, Pargana Baraunsa, Tehsil Jaisinghpur, District Sultanpur.
Today, Shri Rahul Shukla, learned Additional Chief Standing Counsel on the basis of instructions sent by the Sub Divisional Magistrate, Jaisinghpur, District Sultanpur i.e. respondent no. 2 dated 10.02.2024 informs that encroachments have been found over the aforesaid public land namely by one Shri Dayashankar against whom proceedings under Section 67 of the U.P. Revenue Code, 2006 has been initiated.
He further states that endeavor would be made to conclude the aforesaid proceedings in accordance time schedule as prescribed under Code 2006.
