Heard learned counsel for the petitioner, Shri Pankaj Gupta, learned for the respondent No.5 and learned Additional Chief Standing Counsel for State-respondent Nos.1 to 4.

Petitioner has approached this Court that though a patta was allowed in his favour on 04.07.2023 but physical possession is not available to him.

Learned Additional Chief Standing Counsel, on instructions, states that patta though was allotted in favour of the petitioner but thereafter some illegality or irregularity was found and proceedings for cancellation of the same has been initiated under Section 66 of the U.P. Revenue Code, 2006. The last date fixed in the said proceedings was 10.01.2024. He further states that the said proceedings is pending before respondent No.2District Magistrate, Gonda.

In the given circumstances, petitioner is also permitted to participate in the said proceedings. The respondent No.2District Magistrate, Gonda shall conclude the proceedings within a period of six weeks from the date a certified copy of this order is produced before him. Possession shall be subject to the final order passed in the aforesaid proceedings.

The writ petition is disposed of accordingly.

The details of the case are also provided to learned counsel for the petitioner today by the learned Additional Chief Standing Counsel.
