Under challenge is the order dated 04.01.1986 passed by respondent no.2/ Managing Officer/ Tahsildar, Tahsil- Mohamdi, District- Kheri on the application dated 27.08.1985 filed by the original petitioner praying therein to restore the case no.29 decided on 29.06.1985.

Brief facts of the case, as appear from the record, are to the effect that respondent no.2 in a case under Section 7(2) of Displace Person and Rehabilitation Act, of Administration of U.P. Property Act, 1950 (in short the 'Act of 1950) passed the final order 29.06.1985 whereby settled the land, i.e., Gata No.148/1 area 1.64 acres, 167/1 area acres 1.30 and 234/1 area 1.31 acres situated at Village- Pal Abhai Kachnar, Pargana & Tehsil- Mohammadi, District- Kheri, in favour of original respondent no.3-Moharram Ali.

The land in issue was recorded undisputedly in the name of one Barati s/o Hussaini who left for Pakistan in the year 1948-49 and the proceedings thereafter were initiated under the Act of 1950 and the case was registered as Case No.10 titled as 'Union of India vs. Barati Pakistani' and the same was finally decided vide Order dated 29.06.1985.

After final order dated 29.06.1985, the petitioner filed an application on 18.07.1985 praying therein to restore the case to its original number on the ground that without notice to the petitioner, the order dated 29.06.1985 was passed.

The aforesaid application of the original petitioner was rejected vide the impugned order dated 04.01.1986, passed by respondent no.2/ Managing Officer/ Tahsildar, Tahsil- Mohamdi, District- Kheri, which reads as under:-

"q शቦኍ बबारबातቦኍ पपु्ቔ हहससेनቦኍ ननवबासቦኍ पबाल अभय बचनबारसे वरर 1948, 49 मम पबानकिस्तबान चलसे गयसे थसे उनकिकी जबायदबाद नडिस्पलेडि परसन एण्डि ररहहैनवलቦኍटसेशन किकी धबारबा स 7;2 ्ቍ किसे अनपुसबार भबारत सरकिबार किसे किस्टटोनडियन पबापट቏ኍ घटोनरत किर दቦኍ थቦኍ। शቦኍ बबारबातቦኍ किकी भभूनम नम्बरቦኍ 148/1-64, 167/1-30, व 134/1-31 किपुल तቦኍन नकितबा रकिबबा 4-25 लगबानቦኍ 47-50 सस्थत गबाम पबाल अभय किचनबार परगनबा व तहसቦኍल मटोहमदቦኍ किसे ननस्तबारण हसेतपु नटोनटस अन्तगरत परररद आदसेश ससंख्यबा -35/2- नन 0 स 0 नदनबासंकि 7 जपुलबाई 1966 किसे अनपुसबार नदनबासंकि 25-5-85 किटो जबारቦኍ नकियबा गयबा। नटोनटस ननयमबानपुसबार तबामቦኍल किरवबायबा गयबा तथबा आम मपुश्तहरቦኍ किरबाई गयቦኍ। नटोनटस मम यह अंनकित नकियबा गयबा नकि यनदस नकिसቦኍ किटो इस नवरय पर किटोई आपतቈኌ हटो तटो वह नद 0 15-6-85 किटो तलतखित आपतቈኌ मेरसे सम्ቌ पस्तपुत किरस ेस , उस पर ननयमबानपुसबार 15-6-85 सपुनवबाई किकी जबावेगቦኍ। नदनबास ंकि स किटो एकि उजरदबारቦኍ मटोहरम अलቦኍ पपु्ቔ छटोटबार ननवबासቦኍ पबाल अभय किचबानबार किकी पस्तपुत हहई तजसम मटोहरम म अलቦኍ नर े किहबा हस ै नकिह जब से बरबातቦኍ पबानकिस्तबान गयस े हस तब सह े इस जमቦኍनस पर मेरबा किस ब्जबा है। इस किह े स ननस्तबारण हेतपु किस्टटोनडियन किकी जमबाबस न्दቦኍ देखिቦኍ गई उसमस किम ब्जेदबार किस े खिबानस े मस म असगर अलቦኍ व जब्बबार अलቦኍ किबा नबाम दज थबा इसतलए दटोनोሪ किबानबजदबारोሪ किटोर 21-6-85 नटोनटस दቦኍ नटोनटस दቦኍ गई तथबा नततथ ननस्तबारण हेतपु लगबाई गई। असगरस 21-6-85 अलቦኍ व जब्बबार अलቦኍ नदनबांकि स किटो हबातजर आये उस न्होሪने अपनस े बयबान नदयस ेस ह नकि इस जमቦኍन पर मह ेरबा किस ब्जबा किभቦኍ नहह रहबा न इस समय है इस जमቦኍन पर ह जबसे बरबातቦኍ पबानकिस्तबान गयस े हस तब सह े किस ब्जबा मटोहरमर अलቦኍ पपु्ቔ छटोटबा किबा है। ह इसकिकी पपुनቖኌ किरनेस किे तलयस े किबानभूनगटो दबारबा जबास ंच किरबाई गयቦኍ। सस ुर वबाइजर किबानभूनगटो प ने जबास ंच किरकिस े आख्यबा पस्तपुत किकी नकि उ्ሹ भभूनम पर किस ब्जबा मटोहरम अलቦኍ पपु्ቔ छटोटबार किबा है। जह ब्बबार अलቦኍ व असगर अलቦኍ किे बयबान तथबा सस ुर वबाइजर किकी आख्यबा स प ेस यह पभूणतयबा तस्ቍ हटो गयबा हर ै नकि मटोहरह र म अलቦኍ इस भभूनम पर जब से बरबातቦኍस -34/2- नन 0 0 पबानकिस्तबान गये हस तबसह े किबानबज हस ै इसतलयह े परररद आदस ेश सस ंख्यबास ं सस नदनबांकि जपुलबाई स 7, 1967 किे आधबार पर मटोहरस म अलቦኍ पपु्ቔ छटोटबा किर े नबामस ननयमबानपुसबार भभूनम किबा ननस्तबारण किर नदयबा गयबा।

ननस्तबारण किसे बबाद नदनबासंकि 18-7-85 किटो एकि पबाथरनबा प्ቔ शቦኍमतቦኍ नबसनम्ቤन पपु्ቔቦኍ बधबा नसे एकि पबाथरनबा प्ቔ नदयबा नकि मसेरबा नबाम खिसरबा खिततौनቦኍ मम असंनकित हहै तथबा मसेरबा किब्जबा हहै , मपुझसे किटोई नटोनटस नहह दቦኍ गई तथबा एकि प्ቌቦኍय ननणरय ससे तलयबा गयबा। इसतलयसे मपुकिदमबा बबासंजदबायर नकियबा जबाय। इनकिसे पबाथरनबा प्ቔ पर सपुनवबाई हसेतपु तबारቦኍखि ननसश्चत किकी गई सब किबागजबात दसेखिसे गयसे। शቦኍमतቦኍ नबसनम्ቤन पपु्ቔቦኍ बधबा नसे लसेखिपबाल ससे सनन् 1363 फसलቦኍ मम वरबासत किरबा तलयबा नकि बरबातቦኍ मर गयसे हह उनकिसे स्थबान पर शቦኍमतቦኍ नबसनम्ቤन किबा नबाम दजर हटो गवबाहोሪ किसे बयबानोሪ तस्ቍ हटोतबा हहै नकि बरबातቦኍ तजन्दबा हहै दटो सबाल पहलसे पबानकिस्तबान ससे आयसे थसे तथबा थटोड़से नदन रहकिर वबापस चलसे गयसे इसकिसे अलबावबा यनद मर भቦኍ गयसे हहै तटो उइवहैकिभू पबापट቏ኍ पर नकिसቦኍ किटो वरबासत नहह हटो सकितቦኍ क्योሪनकि यह पबापट቏ኍ भबारत सरकिबार किकी हहै।

नडिसपलेडि परसन एण्डि ररहहैनवलቦኍटसेशन एक्ट स 1954 किकी धबारबा 5;2 ्ቍ किसे अधबार पर महैननतजसंग आफकीसर किटो अतधकिबार पबा्቎ हहै नकि वह किस्टटोनडियन किकी भभूनम पर गलत इन्दबाज किटो खिबाररज किर दसे तथबा अनबातधकिकत किब्जबा किटो बसेदखिल किरकिसे भभूनम किबा ननस्तबारण किर दसे। इसकिसे आधबार पर गलत इन्दबाज जटो नबसनम्ቤन किबा लसेखिपबाल व किबानभूनगटो दबारबा नकियबा गयबा थबा वह अवहैध थबा उसकिटो परवबान अमलदरबामद मम महैननतजसंग आफकीसर नसे खिबाररज किर नदयबा तथबा भभूनम किबा ननस्तबारण किर नदयबा।

शቦኍमतቦኍ नबसनम्ቤन किबा किहनबा हहै नकि मसेरቦኍ जबानकिबारቦኍ मम नहह आयबा नकि भभूनम किबा ननस्तबारण नकियबा जबा रहबा हहै। इसकिसे तलए यह किहनबा गलत हहै क्योሪनकि नटोनटस 25-585 किटो जबारቦኍ नकियबा गयबा तजसमम यह तलखिबा गयबा नकि इस नवरय मम तजस नकिसቦኍ किटो आपतቈኌ किरनबा हटो वह नदनबासंकि 15-6-85 किटो तलतखित आपतቈኌ मसेरसे सम्ቌ पस्तपुत किरम। शቦኍ मटोहररम अलቦኍ पपु्ቔ छटोटबा नसे अपनቦኍ आपतቈኌ पस्तपुत किकी। इन्होሪनसे किटोई आपतቈኌ पस्तपुत नहह किकी। इसकिसे बबाद नद 0 21-6-85 तबारቦኍखि ननसश्चत किकी गई। जब्बबार अलቦኍ व असगर अलቦኍ किटो नटोनटस दቦኍ गई उनकिसे बयबान नदयसे गयसे तब भቦኍ इनकिटो जबानकिरቦኍ नहह हहई इस इस बबाद नद 0 29-6-85 किटो भभूनम किबा ननस्तबारण नकियबा गयबा तब तकि इनकिटो जबानकिबारቦኍ नहह हहई। नडिसपलेडि परसन एण्डि ररहहैनवलቦኍटसेशन स - 1955 किकी धबारबा 90 किसे अनपुसबार ननस्तबारण किसे 7 नदन किसे अन्दर यनद किटोई आपतቈኌ किरतबा हहै तटो उस आपतቈኌ किकी सपुनवबाई किकी जबायसेगቦኍ। इसकिसे बबाद उ्ሹ नवरय पर किटोई सपुनवबाई नहह किकी जबायसेगቦኍ। शቦኍमतቦኍ नबसनम्ቤन नसे नदनबासंकि 18-7-85 किटो आपतቈኌ पस्तपुत किकी हहै जटो ननस्तबारण किसे 20 नदन किबा पस्तपुत हहई। इसतलए इनकिकी आपतቈኌ खिबाररज किरनसे यटोग्य हहै।

पबाथरनቦኍ किसे नवदबान अतधव्ሹबा नसे अपनसे तलतखित बहस मम परररद आदसेश प्ቔ ससंख्यबा 16/2- ससंगह /85/64 नदनबासंकि 12-6-84 किसे आधबार पर यह पबाथरनबा किकी हहै नकि गलत इन्दबाज पहलसे खिबाररज नकियबा जबाय उसकिसे बबाद भभूनम किबा ननस्तबारण नकियबा जबाय। यह परररद आदसेश पस्तपुत नहह नकियबा गयबा हहै , किई मतौकिसे पस्तपुत किरनसे किसे तलयसे नदयसे गयसे परन्तपु पस्तपुत नहह नकियबा। परररद किसे प्ቔ नदनबासंकि 15-11-85 मम यह परररद आदसेश असंनकित हहै तजसमम यह स्पቖኌ आदसेश नदयसे गयसे हहै नकि चकिबन्दቦኍ नቅኌयबाओसं मम जटो इन्दबाज गलत नकियसे गयसे हह वह सवरपथम खिबाररज नकियसे नकियसे जबायसे इसकिसे बबाद भभूनम किबा ननस्तबारण नकियबा जबाय। इसतलए यह परररद आदसेश भቦኍ इस पर लबागभू नहह हटोतबा क्योሪनकि शቦኍमतቦኍ नबतसनम्ቤन किबा इन्दबाज जटो नकियबा गयबा हहै वह बरबातቦኍ पपु्ቔ हहसहैनቦኍ वबाररद हबाल पबानकिस्तबान किटो मकतकि घटोनरत किरकिसे नकियबा गयबा हहै। बरबातቦኍ चबाहसे पबानकिस्तबान मम मरसे हटो यबा तजन्दबा हटो इसससे किटोई मतलब नहह हहै क्योሪनकि यह पबापट቏ኍ इवहैकिभू पबापट቏ኍ भबारत सरकिबार किकी हहै इस पर जटो भቦኍ इन्दबाज नकियबा गयबा हहै वह अवहैध हहै तथबा महैनसेतजसंग आफकीसर किटो खिबाररज किरनसे किसे अतधकिबार पबा्቎ हहै। इस पर वबादቦኍ किसे नवदबान अतधव्ሹबा नसे मसेरबा ध्यबान आर 0 डिቦኍ 0 1970 पसेज 543 हर स्वरूप बनबाम किरमटो खिबान किकी तरफ नदलबायबा तजसकिसे अनपुसबार -

Administration of Evacuee property Act 1950 Sec.7 Displaced person (Compensation and Rehabeletation) Act 1954 Sec.12, 27 Property declared as Evacuee property and acquired under Sec.12 of D.P. (C and R) Act by Central Govt. Provisions of Letter Act would apply S.27 of D.P. (C. and R.) Act is complete bar to any order being questioned in any court suit for ejectment of person to whom Evacuee property was sold by managing officer is not maintainable under U.P. Tenancy Act.

मह वबादቦኍ किसे नवदबान अतधव्ሹबा किसे इस तकिर ससे सहमत हहसं। आपतቈኌ किरतቦኍ शቦኍमतቦኍ नबसनम्ቤन किबा इन्दबाज जटो थबा , गलत थबा और मसेरसे पभूवबारतधकिबारቦኍ दबारबा इनकिबा नबाम खिबाररज किरकिसे जटो आदसेश पबाररत नकियबा गयबा थबा , इसकिबा किटोई भቦኍ बबाजदबायर इस न्यबायबालय मम अपलबाई नहह किरतबा हहै। अततः मह इनकिबा बबाजदबायर पबाथरनबा प्ቔ ननरस्त किरतबा हहसं। प्ቔबावलቦኍ दबातखिल दफ्तर हटो।

आदसेश खिपुलቦኍ अदबालत मम दटोनोሪ प्ቌोሪ किटो सपुनबा गयबा।

It appears from the impugned order that notice was duly served upon the concerned and even public notice was issued and thereafter one Moharram Ali preferred an objection in which he stated that Barati went to Pakistan and over the land in issue, he is in possession.

It further appears from the impugned order that upon service of notice, Asgar Ali and Jabbar Ali stated before the concerned authority, who passed the final order dated 29.06.1985, that they are not in possession over the property in issue.

It further appears that for the purpose of final order, the report was also called upon. As per the report of Kanoongo (Revenue Inspector), after Barati left India, Moharram Ali son of Chutta was in possession of the said property.

Thus, the facts in a nutshell that Barati s/o Hussaini, original tenure holder, went to Pakistan and since then, Moharram Ali was in possession of the land in issue, detailed above, has proved before the authority concerned.

Taking note of the aforesaid, the final order was passed on 29.06.1985.

For disposal of present petition, this Court is of the view that the averments made in the application for restoration/ recall of Order dated 29.06.1985 are required to be taken note of, which are is quoted here-in-under:-

1. यह नकि मपुकिदमबा नसं . 29 वबावत भभूनम ससं 0 148/1-64, 167/1-30, 234/1-31 सस्थनत गबाम पबाल अभय किचनबार परगनबा व तहसቦኍल मटोहम्मदቦኍ तजलबा खिቦኍरቦኍ नदनबासंकि 29.06.85 किटो एकि प्ቌቦኍय नननणरत हटो चपुकिबा हहै तजसकिकी जबानकिबारቦኍ पबातथरनቦኍ किटो नदनबासंकि 09.07.85 किटो हहई जब पबातथरनቦኍ नसे खिसरबा खिततौनቦኍ किकी नकिलसे लसेखिपबाल ससे पबा्቎ किकी।

2. यह नकि उ्ሹ भभूनम पबातथरनቦኍ नवतसमलन पपु्ቔቦኍ बन्धबा ननवबासቦኍ पबाल अभय किचनबार परगनबा व तहसቦኍल मटोहम्मदቦኍ तजलबा खिቦኍरቦኍ किसे नबाम खिसरबा व खिततौनቦኍ मसे भभूनमकिरቦኍ मसे असंनकित हहै और भभूनम पबातथरनቦኍ किसे अतधपत्य मम हहै नफर भቦኍ पबातथरनቦኍ किसे पबास न्यबायबालय दबारबा नटोनटस यबा सभूचनबा नहቦኍ भसेजቦኍ गई और न नटोनटस बटोडिर पर सभूचनबा चश्पबा किकी गई एवसं आप घटोरणबा भቦኍ नहቦኍ हहई। समस्त किबायरवबाहቦኍ एकि हቦኍ नदन मम पभूरቦኍ किरकिसे उसቦኍ नदन आदसेश पबाररत किर नदयबा गयबा।

3. यह नकि आदसेश नदनबासंकि 29.06.85 फज቏ኍ अवहैध ननरबाधबार एवसं ननष्पभबावቦኍ हहै गलत तथ्योሪ किसे आधबार पर पबाररत नकियबा हहै। पबातथरनቦኍ किबा उ्ሹ भभूनम मम स्वत्व नननहत हहै और उ्ሹ आदसेश किसे रहनसे ससे पबातथरनቦኍ किसे नहतोሪ पर पनतकिभूल पभबाव पडिसेगबा इसतलय पबातथरनቦኍ मपु 0 नसं 0 29 किटो पपुनस्थबानपत किरवबा किर आपतቈኌ प्ቔ दबातखिल किरकिसे पहैरवቦኍ किरनबा चबाहतቦኍ हहै।

अततः पबाथरनबा हहै नकि मपु 0 नसं 0 29/29.06.85 किटो पपुनरस्थबानपत किरकिसे आपतቈኌ प्ቔ दबातखिल किरनसे किबा अवसर पदबान नकियबा जबावसे तबानकि पबातथरनቦኍ उ्ሹ मपुकिदमबा किकी पहैरवቦኍ किर सकिसे।

From the averments made in the above quoted application, it appears that for the purpose of recall of order dated 29.06.1985 and restoring the case to its original number, the petitioner therein stated that the order is an ex-parte order.

However, contrary appears from the impugned order. A perusal of impugned order reflects that proper notices were issued and thereafter the order was passed and to controvert the findings related to service of notice recorded in the impugned order, no document has been placed on record, accordingly, this Court finds no force in the present petition, which is liable to be dismissed and is accordingly dismissed .
