1. Grievance of the petitioners is that Deputy Director of Consolidation has illegally shifted their chak towards the south side of plot No. 191/2, whereas their house and other improvements are situated towards north side.

Sketch map depicted on the amendment chart appended with the order passed by the Deputy Director of Consolidation evinces that towards extreme north side of plot No. 191/2, chak holder No. 13 has been shifted. Thereafter, chak No. 120 and chak No. 35 are allotted area over there. After chak holder No. 35, towards the sought side chak of the petitioners namely chak No. 188Sa, 118Da, 188Ya, 188Va and 188Aa are situated. Lastly, towards the extreme sought, chak No. 34 has been shifted. As per submission of learned counsel for the petitioner, chak Nos. 13 and 120 have been purchased by the petitioner, therefore, in present scenario chak No. 35 which belongs to the contesting-respondents is situated in the middle of the area of plot No. 191/2 and owing to present location of chak No. 35, entire area of plot No. 191/2, which is in the possession of the petitioner, is divided in two parts.

In this backdrop of the case, learned counsel for the petitioner has urged that chak No. 35 may be shifted towards the south of plot No. 191/2 just before the chak No. 35 and same may be exchanged with chak No. 188 Aa so that both the parties may settle with their respective chaks consisting of the entire area at one place.
