Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondents and Sri Saryu Prasad Tiwari, learned counsel for the private respondents.
As per the instructions dated 03.12.2024, a copy of which has been provided to the Court for perusal and the same is taken on record.
It has been indicated that the records have been re-constructed and the parties have also appeared before the Reference Authorities and the same shall considered and decided at an early date.
In view thereof, this Court is of the view that no gainful purpose will be served in keeping the aforesaid petition pending, accordingly, the petition is disposed of with a direction to the respondent no. 1 to consider and decide the pending reference of the petitioner after affording full opportunity to the petitioner but without granting any unnecessary adjournments to the either of parties preferably within a period of six months from the date an authenticated copy of this order is placed before the authority concerned.
It is made clear that the Court has not examined the case of either of the parties on merits and the authority concerned shall consider and decide the matter strictly in accordance with law.
