Heard Sri Anil Kumar Singh, learned counsel for the petitioners, learned Standing counsel for respondent No.1 .

The supplementary affidavit filed today in the Court is taken on record.

The petitioner has challenged the order dated 12.3.2024 passed by Additional Director of Consolidation (Administration), Lucknow whereby he has transferred appeal No.113/135 (computerized case No.2022541058000117) (Ravidev Singh Vs. Ram Sahai and others) under Section 53 (2) of U.P. Consolidation of Holdings Act from the court of Settlement Officer of Consolidation, Raebareli to Settlement Officer of Consolidation, Unnao. It has been stated that on the application of transfer preferred by respondent No.2 no evidence was adduced which may demonstrate that the allegations leveled by them with regard to the fact that the respondents were seen coming out of the chamber of Settlement Officer of Consolidation, Raebareilly and accordingly in absence of any such cogent evidence order of transfer could not have been passed. He further submits that the petitioner has personal difficulty in approaching before Settlement Officer of Consolidation, Unnao as he has risk of his life at Unnao. The matter requires consideration.

4. Issue notice to opposite party No.2.

Let opposite party No.2 be served through Settlement Officer of Consolidation, Unnao. The registry is directed to serve summons to the Settlement Officer of Consolidation, Unnao who shall take steps to serve it on opposite party No.2 and return the same with with proper endorsement to this Court.

List this case on 23.7.2024.

Till the next date of listing, no final orders shall be passed by Settlement Officer of Consolidation, Unnao in Appeal No.113/135 (computerized case No.2022541058000117) (Ravidev Singh Vs. Ram Sahai and others).
