Heard Shri Arpit Agarwal, learned counsel for the petitioners and Shri Pawan Shukla, Advocate, under the authority of Shri Rakesh Pathak, learned counsel representing the contesting respondents.

This writ petition was filed assailing the order dated 21.05.2024, passed by the Deputy Director Consolidation, Pilibhit, in Revision No. 0149/2017, Computerized Case No. 2017531256000149, Preetam Singh vs. Chhabra and others, whereby and whereunder the Revisional Court proceeded to accept additional evidence even in the absence of any application filed by the Revisionist.

Shri Arpit Agarwal, learned counsel for the petitioners submits that during the pendency of the present writ petition the Revision itself has been finally decided in favour of the petitioners and in all probability the order allowing the Revision would be assailed by the contesting respondents in appropriate proceedings. He submits that since the issue regarding the acceptance of the additional evidence was under challenge in the present writ petition liberty be granted to him to assail the acceptance of the additional evidence in the subsequent writ petition, if filed by the contesting respondents.
