Heard learned counsel for the petitioner, learned Standing Counsel for the Staterespondent and perused the records.

Instant writ petition has been filed with a prayer for expeditious disposal of restoration application being case no. Tajvisani 282+43 filed in proceeding under 109-A (2) of U.P. Consolidation of Holdings Rules which is pending consideration before Consolidation Officer (respondent no. 1).

It is submitted that having being aggrieved with order dated 25.07.2011, present petitioner has filed a restoration application on 16.03.2021 which is pending consideration despite the fact that opposite party is already appeared and case is ready of final adjudication.

Learned Standing Counsel has no objection, if a direction is issued to respondent no. 1 to decide the aforesaid case, expeditiously.

In this conspectus as above, no useful purpose would be served to keep this matter pending. Therefore, this court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case, as mentioned in the writ petition, with a direction to respondent no.1 (Consolidation Officer, Sadar-Ist, Mau) to decide the aforesaid case strictly in accordance with law expeditiously, preferably, within a period of four months from the date of production of certified copy of this order. It is expected that the proceeding shall be considered and decided strictly in accordance with law, after affording opportunity of hearing to both the parties, without according unnecessary adjournments.
