Case called out in the revised list. None is present for the petitioner. However, learned Standing Counsel for the staterespondent is present. Since last three dates i.e. 9.4.2024, 15.5.2024 and 2.7.2024, the matter has repeatedly been adjourned on the request of learned counsel for the petitioner. Today again none appeared to press the instant writ petition.

Instant writ petition has been filed at a very belated stage on 22.3.2024 assailing the order dated 10.6.2022 passed by Deputy Director of Consolidation whereby restoration application dated 23.11.2021 filed on behalf of the present petitioners against the order dated 30.10.2002 has been rejected.

Perusal of the order passed by the Deputy Director of Consolidation reveals that he has dismissed the restoration application on the ground that there is nothing on the record as to how the petitioner is an interested person in the previous proceeding and as to how he is prejudiced with the order challenged under the restoration application. No sufficient reason has been assigned for the delay caused in filing the restoration application. I do not find any illegality, perversity or irregularity in the order passed by the Deputy Director of Consolidation so as to warrant indulgence of this Court in exercise of extraordinary jurisdiction under Article 226 of the Constitution of India.

Resultantly, instant writ petition, being misconceived and devoid of merits, is dismissed.
