The contention of learned counsel for the petitioner is that initially the petitioner had been suspended vide order dated 10.09.2015, a copy of which is Annexure-1 to the petition, on the ground of pendency of a criminal case.
The contention is that the aforesaid criminal case bearing S.T. No.318 of 2015 in re: State of U.P. vs. Mohd. Miyan Rizvi has resulted in acquittal of the petitioner by the competent court vide judgment and order dated 20.07.2024, a copy of which is Annexure-4 to the petition. It is thus contended that once the suspension of the petitioner was only on account of pendency of criminal case which has resulted in acquittal there cannot be any occasion for continuance of the suspension of the petitioner.
