Heard Shri Jitendra Kumar Upadhyay, learned counsel for the petitioner and Shri Shailendra Singh, learned Standing Counsel for the State.

By means of the instant writ petition filed under Article 226 of the Constitution of India, the petitioner has prayed for issuance of writ of mandamus to pass appropriate orders for granting financial approval to the petitioner's appointment on the post of Assistant Clerk in Janta Vidyalaya Inter College, Magorra, Mathura.

Learned Standinding Consel has no objection against the grant of limited prayer of the petitioner.

Keeping in view the aforesaid discussion, the instant petition is disposed of without issuing notice to respondent No.3 directing the respondent No.2-District Inspector of Schools, Mathura to pass appropriate orders regarding the grant of financial approval in respect of petitioner's appointment on a post of Assistant Clerk in Janta Vidyalaya Inter College, Magorra, Mathura, in accordance with law, within a period of two months from the date of receipt of a certified copy of this order.

It is made clear that this Court had not adjudicated upon merits of the case and the same is to be done by the District Inspector of Schools concerned.
