By means of this petition, the petitioner has assailed the transfer order dated 10.08.2024 passed by the Additional Superintendent of Police Establishment on behalf Additional Director General of Police Establishment modifying the earlier transfer order dated 29.06.2024, transferring the petitioner from Lucknow to Firozabad. The petitioner has also assailed the relieving order dated 12.08.2024, whereby, the petitioner has been relieved for the transferred place, i.e., Firozabad. Learned counsel has stated that one anonymous and unsigned complaint has been lodged by one Satish Singh (Annexure No. 6), whereby, some false and misconceived allegation has been levelled against the petitioner and on such complaint, the report has been filed from the office of Director General of Police dated 06.08.2024 (Annexure No. 7). Pursuant to the aforesaid development, the impugned transfer order dated 10.08.2024 has been issued. Learned counsel has stated that even if the allegation of the complaint is read on its face value, the petitioner has allegedly bailed out six accused persons from the Police Station itself, whereas, the offence is bailable in nature, therefore, the Station House Officer is entitled to grant bail after completing the necessary exercise and such exercise has been undertaken by the petitioner and the seized/confiscated item has not been released. He has lastly submitted on the admission stage that on the basis of anonymous and unsigned complaint, no action can be taken by the competent authority.
