Heard learned counsel for petitioner and learned counsel for opposite party No.2.
In pursuance of directions issued earlier, short counter affidavit filed on behalf of opposite party No.2 as well as supplementary affidavit filed on behalf lf petitioner is taken on record.
Learned counsel for opposite party No.2 has adverted to the order dated 27th April, 2005 to submit that the Osra Bandi Scheme under which petitioner had earlier been posted in the district was not found to be conducive due to which the post of Deputy Revenue Officer was thereafter re-deployed from the districts with net result that as of now there is no such post in the district.
Learned counsel for petitioner has however adverted to the letter dated 22nd April, 2008 issued by the State Government in pursuance of the government order dated 18th July, 1991 to submit that such re-deployment can be issued only from the State Government and not from any authority subordinate to it and therefore the order dated 27th April, 2005 having not been issued by the State Government is meaningless.
Learned counsel for petitioner prays for and is granted three days time to file supplementary affidavit to bring on record the government letter dated 22nd April, 2008.
List this case on 4th October, 2024 as fresh in order to enable learned State Counsel to obtain instructions in this matter.
