Be that as it may, this Court has passed a detailed judgment and order, by which the time schedule was fixed and the concerned State authority has expressed inability as to how the enquiry could not be concluded within the time frame coupled with the fact that the petitioner did not cooperate in the enquiry proceedings in spite of various letters issued to her to defend herself. Therefore, looking to the facts and circumstances of the case and also the fact that alleged financial irregularity was committed by the petitioner, it would be expedient in the interest of justice, I direct that the enquiry should be concluded by the enquiry officer within the time framed by this Court from the stage of filing of reply to the charge sheet. Since the reply has already been submitted by the petitioner, the enquiry officer will conclude the enquiry within two months from today after giving opportunity of hearing to the petitioner and will submit the enquiry report to the disciplinary authority not later than 20.5.2024. Thereafter, the disciplinary authority will issue show cause notice to the petitioner within 15 days, to which the petitioner will submit her reply within next 15 days. The disciplinary authority will pass final order within 15 days thereafter. The petitioner will cooperate in the enquiry and will not seek any unnecessary adjournment so as to conclude the enquiry within the time stipulated. In case the petitioner does not cooperate in the enquiry, it will open for the enquiry officer to conclude the enquiry ex-parte and submit report to the disciplinary authority within the time frame.
