It has been submitted that the issue under question as indicated in the earlier order dated 22.07.2024 passed in Writ-A No. 5475 of 2024 was adjudication before Division Bench of this Court at Allahabad in Writ-A No. 10686 of 2024, Govind Kaushik and others versus State of U.P. and others and the aforesaid petition was disposed of vide order dated 29.07.2024 but subsequently the Division Bench at Allahabad has again taken cognizance of the issue in Writ-A No. 9970 of 2024, Neerja and others versus State of U.P. and others.

A perusal of order dated 02.08.2024 passed in the case of Neerja (supra) indicates that the exercise required to be conducted by the State authorities for ascertaining the studentsteachers ratio as on 30.06.2024 may be conducted in a hurried manner since a very short time line has been provided for determination of posts and identification of teachers who may be surplus and therefore required to be adjusted. The Division Bench has therefore sought personal affidavits of the Secretary, Basic Education Board and the Additional Chief Secretary, Basic Education. The case is due to be listed on 08.08.2024. Interim protection has also been provided that no transfer order would be passed till next date of listing.

Since the present dispute also pertains to the same as is under adjudication before the Division Bench at Allahabad, list this case on 12.08.2024, as fresh. In terms of the interim protection provided by Division Bench in the case of Neerja (supra), it is provided that no transfer order shall be passed till the next date of listing.
