1. Heard Sri Anurag Mehrotra, the petitioner who appears in person and Sri Vikas Singh, learned Standing Counsel for the State-respondents.

2. Sri Anurag Mehrotra, has submitted that his wife is critically ill and she has been suffering from critical lungs ailment since 22.10.2023. He has further submitted that he being a retired government servant is legally entitled for medical reimbursement of his wife and despite the fact that he has completed all the required formalities has submitted the medical bill but he has not been paid the reimbursement amount.

3. In the present case, the amount of medical bill is Rs.3,09,934.68. For getting the aforesaid amount of medical reimbursement, he has preferred a representation dated 30.06.2024 (Annexure No.1) to the Additional Commissioner (Grade-I), State Tax, Lucknow Zone-I, Lucknow but he has not been given payment till date.

Sri Anurag Mehrotra, the petitioner, has further submitted that day before Yesterday i.e. 21.07.2023 the team of Doctors at Astha Medical Centre, Lucknow where wife of the petitioner is presently admitted has told him to get his wife discharged for getting treatment at better hospital and they have referred her for KIMS Hospital, Hyderabad but the petitioner is running out of funds. Therefore, he is not able to get his wife discharged from Lucknow to Hyderabad.

Considering the aforesaid pathetic condition of the wife of the petitioner, as stated by the petitioner, I find it appropriate that a specific written instructions be called from the Competent Authority and if there is no legal impediment, by the next date of listing the petitioner may be given the payment of medical reimbursement through a demand draft. If there is any legal impediment, such legal impediment shall be intimated to the petitioner by the next date of listing. It is needless to say that if in the absence of appropriate funds the life of the wife of the

petitioner receives a serious threat, it would not be acceptable.

6. List this case on 26.07.2024 as fresh. On that date, this matter shall be taken up at 12:45 p.m.

7. On that date, any responsible officer shall not only provide the instructions to the learned Standing Counsel but shall also produce the relevant papers relating to the issue in question.
