Let a supplementary affidavit be filed by the petitioners to demonstrate that after de-reservation of vacancies vide order dated 27.01.1988 and 05.02.1988, albeit as claimed with effect from 10.01.1986, the respondents herein were appointed against the said de-reserved vacancies and therefore they cannot possibly be treated as regularized or regularly appointed from a prior date that is a date prior to their regularization against such de-reserved vacancies, with the help of documentary records, which shall be annexed. It would be better if original records are also produced before the Court on the next date.
It is the case of the petitioners that de-reservation of vacancies on the post has not been considered by the Tribunal in spite of the plea having been raised before it, whereas learned counsel for the opposite party says that the Tribunal has held that the post against which the respondents were appointed were not reserved/de-reserved posts.
