Heard Sri Surya Mani Singh, learned counsel for the petitioner, learned Standing counsel appearing on behalf of the State-respondents no. 1 to 6 and Sri R.K.Upadhyay, learned counsel for the respondent no. 7.

With the consent of learned counsel appearing on behalf of the contesting parties, the instant writ petition is being finally decided.

Learned counsel for the petitioner after arguing at some length prays that as after an inquiry that had been conducted against the petitioner, a Show Cause Notice dated 24.01.2024 along with the inquiry report, a copy of which is annexure 4 to the writ petition had already been served upon the petitioner to which the petitioner has submitted his reply on 19.02.2024, a copy of which is annexure 15 to the writ petition and the respondents have failed to pass any final order upon the same as such, he confines his prayer to the competent authority passing a final order after considering the reply of the petitioner dated 19.02.2024 within a specified time.

To the aforesaid prayer, learned Standing counsel as well as Sri R.K.Upadhyay, Advocate have no objection.

Accordingly, considering that in pursuance to the Show Cause Notice dated 24.01.2024 issued to the petitioner, the petitioner has already submitted his reply on 19.02.2024 and despite lapse of more than two months, no final order has been passed till date as such, the writ petition is disposed of with the direction to the competent authority to pass a final order in the inquiry of the petitioner after considering the explanation of the petitioner dated 19.02.2024 within a period of three weeks from the date of receipt of a certified copy of this order.

It is made clear that this Court has not gone into the merits of the case as set forth by the petitioner.
