The present petition has been filed with the following reliefs :-
"(i) issue a writ, order or direction in the nature of mandamus commanding the opposite parties to revise the pension of the petitioner on the basis of last pay drawn by him, with effect from 01.08.2021 and the arrears accrued due to re-fixation of pension be also released in his favour.
(ii) issue a writ, order or direction in the nature of mandamus commanding the opposite parties to release the withheld amount of Rs. 5,28,130/- from gratuity and also release the remaining amount of Rs. 1,57,360/- of leave encashment in favour of the petitioner.
(iii) issue a writ, order or direction in the nature of mandamus commanding the opposite parties to allow interest @12% to the petitioner on the arrears of pension, and withheld amount of gratuity and leave encashment from the date of accrual upto the date of actual payment."
The petitioner retired from service while posted at Moradabad Development Authority, District-Moradabad.
The jurisdiction to decide the present petition does not lie before the Lucknow Bench of Allahabad High Court.
The counsel for the petitioner prays that the present petition be dismissed as withdrawn with liberty to file fresh petition before the Allahabad High Court.
The petition is dismissed as withdrawn with liberty as prayed.
The petitioner shall be at liberty to file any instrument for redressal of his grievance before any other forum having the jurisdiction to decide the issue raised by the petitioner in accordance with law .
