Heard learned counsel for petitioner, learned State Counsel for opposite party no.1 while counter affidavit has been filed on behalf of opposite party nos.2 to 5, who remains unrepresented.

Petition has been filed seeking a direction to the concerned authority to take a final decision with regard to candidature of petitioner for compassionate appointment in view of the fact that petitioner's father, late Shishu Pal, passed away in service on 25.06.2013.

It appears from the counter affidavit filed on behalf of Corporation that after demise of the employee, one Basanti Devi and Shubham Kumar filed applications for compassionate appointment, which were rejected on 24.02.2016. It is stated in the counter affidavit that the same were never challenged but subsequently the petitioner filed a fresh application dated 21.10.2019, which being beyond the stipulated time period of five years, was referred to the State Government in terms of Rule 5 of the U.P. Recruitment of Dependants of Government Servants Dying in Harness Rules, 1974 vide letter dated 23.12.2021, where it is pending consideration till date.

In view of aforesaid submission on the part of Corporation, the opposite party no.1 i.e. Additional Chief Secretary (Irrigation), Irrigation Department, Government of U.P., Civil Secretariat, Lucknow, is directed to take a decision on the recommendation dated 23.12.2021 vide letter no.6238 sent by the Corporation. Reasoned decision shall be taken within a period of eight weeks from the date a certified copy of this order is produced before the concerned authority.

With the aforesaid directions, the present writ petition is disposed of.
