Heard Shri Dwijendra Prasad, learned counsel for the petitioner, learned Stanhding Cousnel for the respondent-State and Shri No.1-State and Bhupendra Kumar Yadav, learned counsel for the respondent-Zila Basic Shiksha Adhikari.
The petitioner claims for disbursal of his pension. A representation has been made in this regard but the same has not been decided till date. The only prayer made by the learned counsel for the petitioner is that the representation of the petitioner for disbursal of his pension be decided within a stipulated period of time.
Learned Standing Counsel submits that the matter requires factual determination as per applicable law by the competent authority in the first instance. However, the learned Standing Counsel and the counsel for the respondents fairly contend that his claim for disbursal of pension are liable to be decided by the competent authority within a reasonable time frame.
In the wake of the preceding discussion and without going into the merits of the case, the respondent No. 3-Zila Basic Shiksha Adhikari, Firozabad is directed to decide the claim for disbursal of pension of the petitioner within a period of three months from the date of receipt of a certified
copy of this order along with a fresh copy of the representation.
The Zila Basic Shiksha Adhikari, Firozabad will be liable for delay in processing the aforesaid claim as per law.
With the aforesaid direction, the writ petition is finally disposed of.
