Heard learned counsel for petitioner, State Counsel for opposite party No.1 and Mr. Shubham Tripathi learned counsel for opposite parties 2 to 4.

Petition has been filed seeking a direction to opposite parties for payment of family pension along with arrears thereof in view of the fact that petitioner's mother Smt.Guddi has passed away on Ist September, 2008. It is further submitted that family pension was earlier made admissible to petitioner's sibling Kumari Nishi who has also thereafter passed away on 4th December, 2022 while petitioner's brother has been provided compassionate appointment.

It is submitted that in view of passing away of Kumari Nishi, petitioner also being daughter of Kumari Guddi is entitled for family pension being a dependant unmarried daughter.

Learned counsel appearing on behalf of opposite parties 2 to 4 on the basis of instructions submits that as per letter dated 8th January, 2024, certain relevant documents have been sought for from petitioner and the family pension would be made admissible to her in case she is entitled to the same in accordance with documents which are submitted to petitioner

Considering the aforesaid facts, petitioner is granted liberty to submit relevant documents as required vide letter dated 8th January, 2024, a copy of which has been provided to learned counsel for petitioner, within a period of two weeks from today. Upon submission of relevant documents, final decision shall be taken by opposite parties regarding payment of family pension and arrears thereof.
