Heard Shri Brij Bhushan Upadhyay, learned counsel for the petitioner and learned Standing Counsel for the Staterespondents.
Petitioners claim the benefit of assured career progression scheme. A representation in this regard has been made by the petitioners but to no avail.
Learned Standing Counsel contends that the claim of the petitioners requires factual adjudication in the light of applicable law by the competent authority in the first instance. However, he fairly submits that such determination is liable to be decided within a reasonable period of time.
In the wake of preceding discussion and without going into the merits of the case, the respondent No.2Additional Director General of Police, Lucknow as well as respondent no.5 Commandant, 42nd Battalion, PAC, Naini, Prayagraj shall decide the claim of the petitioner for benefit of assured career progression scheme as per law,
preferably, within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
With the aforesaid direction, the writ petition is finally disposed of.
