Heard learned counsel for petitioner, learned State Counsel appearing on behalf of opposite party No.1 and Mr. Rishabh Tripathi learned counsel for opposite parties 2 to 4.

Petition has been filed seeking a direction to the opposite parties to pay amount of leave encashment along with arrears with regard to benefit of 7th Pay Commission recommendations along with interest on the delayed payment.

It has been submitted that petitioner superannauted on 17th October, 2022 but the aforesaid payment has not yet been made.

Since consideration of petitioner's grievance would entail factual aspects, liberty is granted to him to make a fresh representation before the opposite party No.3 i.e. Divisional Logging Manager, U.P. Forest Corporation, District Mirjapur or any other competent authority who shall consider and decide the same within a period of six weeks from the date a certified copy of this order is submitted before him. In case petitioner is found entitled for the same, actual payment shall be ensured within a period of six weeks thereafter. The said authority shall also consider petitioner's grievance with regard to payment of interest on delayed payment.

With the aforesaid directions, the writ petition stands disposed of.
