Heard the counsel for the parties.

The present petition has been filed challenging the order dated 11.4.2023 passed by the Registrar, Babasaheb Bhimrao Ambedkar University, Lucknow denying promotion to the petitioner by refusing to count his past service.

It has been stated in the petition that the petitioner has already filed an appeal against the aforesaid order of the Registrar before the Board of Management of the University and the said appeal is pending.

A prayer has also been made that, in the alternative, an order be passed directing the Board of Management of the University to decide the appeal of the petitioner.

As the issue raised by the petitioner in the present petition is already under consideration before the Board of Management of the University, I do not consider it to be a fit case for interference by this Court under Article 226 of the Constitution of India, at this stage.

The petition is disposed of with a direction to the Board of Management of Babasaheb Bhimrao Ambedkar University, Lucknow to decide the appeal of the petitioner, in accordance with law, within a period of three months from the date a certified copy of this order is produced before it.

With the aforesaid direction, the writ petition is disposed of .
