Heard learned counsel for the petitioners and learned standing counsel for State- respondents.

Present petition has been filed seeking following relief:-

"a). Issue a writ, order or direction in the nature of mandamus commanding the opposite parties to pay the minimum of the pay scale as has been given to similarly situated person namely Pawan Kumar Singh vide order dated 16.1.2023 till their regularization on group "D" posts.

(b) Issue a writ order or directing in the nature of mandamus commanding the opposite party no.2 to consider and decide the application dated 17.10.2024 by providing the benefit of Government Order dated 24.9.2024 as well as law laid by Hon'ble Supreme Court of India in case of Sabha Shankar Dube vs. Divisional Forest Officer and others."

Learned counsel for the petitioners submitted that for redressal of his grievance, petitioner has filed representation dated 17.10.2024 before respondent authorities, but no decision has been taken till date. Lastly, it is submitted that a direction may be issued to respondent authorities to decide the representation within a stipulated time.

Learned Standing Counsel for respondents submitted that petitioner may be directed to file fresh representation before the respondent no.2. Further, in case any such representation is filed, the same shall be considered and decided at the earliest.

In view of the facts and circumstances of the case, the writ petition is disposed of with liberty to petitioner to move fresh separate representation along with certified copy of this order before respondent No. 2 within two weeks from today. In case any such representation is filed, respondent No. 2 is directed to decide the same in accordance with law maximum within a period of six weeks thereafter.

It is made clear that this Court has not adjudicated the case on merits. It is upon respondent No. 2 to pass order after considering the relevant Rules as well as facts of the case.
