1. Heard Sri Shubham Tripathi, the learned counsel for the petitioner, Sri Gaya Prasad Singh, the learned Standing Counsel and perused the records.

By means of the instant writ petition filed under Article 226 of the Constitution of India the petitioner has sought payment of of salary for the period 01.05.2016 to 31.08.2017 during which he remained under suspension/termination which was subsequently disapproved by the U.P. Secondary Education Board, Prayagraj by means of an order dated 04.04.2019. Although, the petitioner was permitted to join his duties and was being paid his salary the arrears for the aforesaid period was not paid to him. On 26.09.2023 the Director, Secondary Education, U.P. has written a letter to the Regional Joint Director of Education (Secondary) Gorakhpur Region, Gorakhpur stating that the petitioner has repetitively made requests for payment of arrears of salary for the period 01.05.2016 to 31.08.2017 but no action in this regard has
