Ganesh Kumar Kannaujiya, Sub-Divisional Magistrate, Soraon, Prayagraj has appeared in compliance with the order dated 22.07.2024. He has filed his personal affidavit today wherein he has indicated that by his order dated 17.05.2024 he has recalled the order dated 31.03.2024 and sought legal opinion in the matter.
It is mentioned in the affidavit that the Sub-Divisional Magistrate and the other functionaries of the State, who are respondents to this writ petition, have been advised to appeal the judgment and order of this Court dated 18.10.2023 passed in Writ-A No. 17720 of 2023. A special appeal has been drafted and would be served upon the learned Counsel for the petitioner today.
Accordingly, this matter is adjourned as fresh to 16.08.2024 . By that time, the Court will be apprised of the orders passed by the Division Bench in special appeal.
The personal presence of the Ganesh Kumar Kannaujiya, SubDivisional Magistrate, Soraon, Prayagraj is exempted unless otherwise ordered.
