The petitioner is a Senior Assistant Clerk, who was posted with the 17th U.P. (G) Battalion, NCC, Kanpur and has now been transferred to the 49th U.P. Battalion, NCC, Deoria by the impugned order.

Transfer is an incident of service. The petitioner says that his transfer is in breach of the State Government's Transfer Policy, 2024 inasmuch as the petitioner's wife is posted at Kanpur as an Assistant Teacher with a school of the Basic Shiksha Parishad.

Be that as it may, transfer being an incident of service, it is not for this Court to interfere in the impugned transfer order. Nevertheless, in case the petitioner represents his case to the Additional Director (Personnel) N.C.C., N.C.C. Directorate, Lucknow, the Additional Director aforesaid shall consider the petitioner's case and pass appropriate orders within a week of receipt of the petitioner's representation. The orders passed by the Additional Director shall be communicated to the petitioner within three days of the orders being recorded.

This petition is disposed of in terms of the aforesaid order.

Let this order be communicated to the Additional Director (Personnel) N.C.C., N.C.C. Directorate, Lucknow through the Chief Judicial Magistrate, Lucknow by the Registrar (Compliance) within 48 hours.
