Heard Sri Adarsh Singh learned counsel for the writ petitioners and Sri Manoj Srivastava learned Standing Counsel, who appears for respondent nos.1 and 2.

In view of the order which is being proposed to be passed, notice was not issued to the third respondent.

The case of the writ petitioners is that there happens to be an institution by the Committee of Management Sri Durga Ji Inter College Chandeswar, Azamgarh third respondent which is recognized under the provisions contained under the U.P. Intermediate Education Act 1921 and is also governed under U.P. Act No.24 of 1971 stands applicable. It is the case of the writ petitioners that pursuant to the selection proceedings held on 12.01.2014 the writ petitioners were selected on the post of ClassIV and were accorded appointment on 20.01.2014 and accordingly they joined on the post on 25.01.2014. However, the financial approval was not accorded to the writ petitioners, the writ petitioners along with the other preferred Writ Petition No.46127 of 2014 (Pawan Kumar and others vs. State of U.P. and others), which was finally disposed of vide order dated 01.09.2014 with certain directions. Pursuant to that the District Inspector of Schools, Azamgarh has accorded approval on 09.10.2022, however, despite the approval the writ petitioners are not being paid salary. Prayer in the present writ petition is sought grant of salary.

Learned Standing Counsel on the other hand submits that the issues which the writ petitioner seeks to raise needs determination at the first instance by the District Inspector of Schools, Azamgarh, first respondent and the writ petitioners may put their claim before the said authority.

Having heard learned counsel for the parties and after perusal of the record, I am of the opinion that the writ petitioners may represent their cause before the first respondent by filing a comprehensive representation along with self attested copy of writ petition and certified copy of order before the first respondent, who shall address to the claim of the writ petitioners bearing in mind the issue as to whether the order dated 09.10.2022 according approval is final or not after putting to notice to the third respondent within three months.

With the aforesaid observation, the writ petition is disposed of.
