1. Heard Shri Raj Karan Singh, learned counsel for the petitioner, learned Additional Chief Standing Counsel for the State and Shri Ratnesh Chandra, learned counsel for the Awas Evam Vikas Parishad.

The cause raised in this writ petition, which is by way of a Public Interest Litigation, is that certain land was allotted to opposite party no. 5 by the Awas Evam Vikas Parishad for constructing a Community Center, but, instead of constructing the same he has been using it for his own private purpose for past more than 14 years as the land was allotted to him in 2010.

Shri Ratnesh Chandra, learned counsel for the Awas Evam Vikas Parishad fairly submits that he has written instructions to inform the Court that the contention of the petitioner's is correct and therefore, the opposite party no. 5 has been given a notice on 13.02.2024 for showing cause for cancellation of allotment.

4. The question is apart from cancellation what about the damages/ compensation for use of public land allotted by Awas Evam Vikas Parishad for private purposes.

Let dasti notice be issued to the petitioner for service upon the opposite party no. 5 through the opposite party no. 2 who has allotted the land to opposite party no. 5, meaning thereby, the dasti notice shall be served by the petitioner in the office of opposite party no. 2 who shall ensure its service upon the opposite party no. 5 and file an affidavit of service in this regard.

6. The affidavit can be filed by any Officer sub-ordinate to the Housing Commissioner.
