Heard Mr. Nikhil Pandey, learned counsel holding brief of Shri Dinesh Kumar, learned counsel for the petitioner, learned State Counsel for opposite parties no.1 to 4 and Mr. Dilip Kumar Pandey, learned counsel for opposite party no.5.

In view of the order being passed notice to opposite party no.6 stands dispensed with.

Present petition has been filed seeking a direction to the opposite parties for the removal of the alleged illegal encroachment over gata no.1290/0.0190 & 1288/0.0190 hectare, situated at village Aihar, Tahsil – Dalmau, District – Raebareli.

Learned State Counsel on the basis of the written instructions dated 25.5.2024, a copy of which is taken on record submits that upon inspection illegal encroachment was found over the aforesaid gatas for which proceedings under Section 67 of the Revenue Code have been initiated and are pending consideration with 30.5.2024 being the next date fixed.

In view of the aforesaid, the concerned authority is directed to conclude the aforesaid proceedings within the statutory time limit after holding an opportunity of hearing to all concerned including aforesaid encroachers.

With the aforesaid directions, present writ petition stands disposed of.
