Heard learned counsel for petitioner and learned State Counsel for opposite parties 1 to 3 and 6 while power on behalf of opposite parties 4 and 5 has been filed by Mr. Saurabh Gupta, Advocate which is taken on record.

Petition has been filed seeking a direction to authority concerned to ensure removal of alleged illegal encroachment by private opposite parties over Gata No.1015/2.352 hectare situate at Villge- Sarsawan, Pargana Bijnore, Tehsil Sarojani Nagar, District Lucknow.

Mr. Rahul Shukla, learned State Counsel has however raised a preliminary objection that although in the entire petition, the aforesaid Gatas have been indicated as pond but in the Khatauni concerned, aforesaid Gata has been indicated as river and therefore the entire basis of the petition is incorrect.

The submissions as made by learned State Counsel are made out from the material on record.

In view of aforesaid, petitioner is granted liberty to approach the authority concerned in accordance with law.

With aforesaid directions, the writ petition stands disposed of .
