Having heard the learned counsel for the parties and perused the averments made in the application seeking condonation of delay, the application is allowed and the delay in filing the special appeal is condoned.

Heard learned State Counsel and Sri O.P.M.Tripathi, learned counsel representing the sole respondent.

Under challenge in this Special Appeal is the order dated 04.01.2006, passed by the learned Single Judge in Writ Petition No. 1502(SS) of 2003, whereby quashing the order impugned therein, learned Single Judge has issued direction to the appellants herein to appoint the respondent-petitioner on the post of Collection Amin on a regular basis from the date, his juniors were appointed.

It has been informed that pursuant to the said order, appointment of the respondent-petitioner has been made on the post of Collection Amin on regular basis and he has even been promoted to the post of Revenue Inspector.

In view of the aforesaid, we do not find it appropriate to

interfere in the order passed by the learned Single Judge.

The Special Appeal is, thus, dismissed.
