1. Shri Jayanti Prasad, Deputy Director from the Forensic Laboratory, Mahanagar, Lucknow is present in pursuance of our earlier order.
2. The appellants' Counsel have placed before us the original records. As per Shri Jayanti Prasad, 11 original documents containing the signature and writing of respondent no.1 are required. The said 11 original documents includes the application alleged to be containing the writing/signature of the respondent no.1 along with which he is alleged to have submitted the fabricated ITI certificate. Therefore, it is to be ascertained as to whether the said writing/signature on the said application, which is dated 04.07.1989 is that of the respondent no.1 or not.
3. The said 11 documents have been taken out by the appellants' Counsel and they have been handed over to Shri Jayanti Prasad before us. In addition to it, the respondent no.1 – Raja Ram, who is present in Court and has been identified by his Counsel Ms. Vishwa Mohini, has written on 6 other blank pages in his own writing in hindi for the purposes of the forensic examination. These 6 pages have also been handed over to Shri Jayanti Prasad.
4. All these documents have been put in a sealed cover in the presence of Shri Jayanti Prasad and respondent no.1 – Raja
Ram as also Ms. Vishwa Mohini, her Counsel. We further direct the Bench Secretary of this Court -Shri Deepak Gaud to certify the writing on 6 pages referred above as the same have been written in his presence. This is necessary as per the procedure of the lab as informed by Shri Jayanti Prasad. Sealed cover has been handed over to Shri Jayanti Prasad during the court proceedings.
5. The Counsel for the appellants says that all 11 original documents which are being handed over to Shri Jayanti Prasad, photocopies thereof have been prepared by the appellants.
6. Shri Jayanti Prasad informs us that it will take about a month to complete the forensic examination.
7. Shri Jayanti Prasad shall sign in the margin of the order sheet as he is present in Court so will respondent no.1- Raja Ram.
8. Let this matter come up on 16.10.2024.
9. The forensic laboratory shall submit its report before the next date in sealed cover.
