Learned counsel for the appellants has submitted that after the judgment dated 29.9.2022 whereby the appeal of the appellants was dismissed on the ground industry comes within the purview of Section 2 (e) of the Real Estate (Regulation and Development) Act, 2016 (hereinafter to referred as " the Act, 2016") subsequently in May, 2024 the said issue has been decided by the RERA Appellate Authority and held in judgment dated 7th May, 2024 in Appeal No. 523 of 2022 that the industry does not come within the purview of Section 2 (e) of the Act, 2016, so the appellant may be permitted to withdraw the present appeal at this stage with a liberty to file a review petition before the appellate authority.

As prayed by the learned counsel for the appellants, the present appeal is dismissed as withdrawn at this stage with a liberty to avail the remedy as permissible under the law.

Certified copies of the orders may be returned to the learned counsel for the petitioner after retaining the photocopies of the same.
