Petitioner's counsel submits that father of the petitioner lodged an F.I.R. at Police Station-Rampur Mathura, District-Sitapur bearing Case Crime No.0092/2024 under Sections-366, 506 I.P.C. The girl was recovered on 06.03.2024 but she was not handed over to the father. She was illegally detained at the police station and only after notice of this petition was given to the Government Advocate on 13.03.2024 that thereafter, yesterday, the girl has been released. He has produced the girl before us. She has stated that one R.P. Gupta had taken her to Lucknow and kept there for two days and ultimately, the police recovered her but did not hand her over to her father. She alleges that ever since then she was kept in prison till yesterday at 06:00 P.M. from the court where she had been taken for medical examination. On being asked as to for what purpose she was taken to the court, she stated that she was taken for recording of her statement and medical examination. The question is whether she was kept in custody of the police till yesterday after she had been recovered, if so, under what authority. She also alleges ill-treatment by some police official whom she refers as Anita Madam. The girl at present is residing at Village-Chandela, P.S.-Rampur Mathura, District-Sitapur with her father. The father-Ravindra Kumar @ Ramendra Kumar is also present in Court. On being asked, he submitted that the girl was recovered by the police on 05/06.03.2024. The girl as also the father both say that though the accused was arrested, he was let off and sent to his Bua's house and was not arrested. The girl also says that she has stated before the court below that the accused-R.P. Gupta had forcibly taken her away in a vehicle which was driven by his Jija on 01.03.2024 and had physically abused her.
