Sri Aditya Tiwari, learned counsel for the appellant prays for adjournment whereas this case is listed today peremptorily as the case was being got adjourned by learned counsel for the appellant and the objection was also raised by Sri Anurodh Srivastava as well as Sri Rajeev Kumar,Advocate holding brief of Sri Shikhar Anand, learned counsel for the respondents on the last date.
Despite repeated asking to argue the matter as the case is old and listed peremptorily, learned counsel for the appellant does not argue.
In view of above, the appeal is dismissed for non-prosecution.
Interim order, if any, stands vacated.
The money deposited before this Court and the lower court record shall be remitted to the concerned tribunal forthwith.
