Shri Brijesh Kumar Singh, Advocate holding brief of Shri Sukh Deo Singh, learned counsel for the appellant submits that the right of recovery from the appellant has been granted to the Insurance Company merely on the ground that the fitness certificate of the vehicle No.UP-42-T-9283 of the appellant was not valid on the date and time of the accident i.e. 08.01.2018, whereas it could not have been a ground for granting right of recovery. Even otherwise it had expired only two days back and it was renewed after four days. He relies on a Coordinate Bench judgment of this court dated 14.08.2024 passed in a Bunch of cases, the leading of which is United India Insurance Co.Ltd. Versus Smt. Shalini Pandey and 5 others in First Appeal From Order No.2473 of 2015.
