The order dated 26.02.2024 passed by Additional District and Session Judge, Court No. 5, Bulandshahar in Criminal Revision No. 453 of 2023 whereby the order dated 08.09.2022 passed by learned Magistrate rejecting the application under Section 156(3) Cr.P.C. of opposite party no. 2 has been set aside and remanded the matter to the Magistrate concerned to pass fresh order, is the subject matter of challenge in the present case.
Admittedly, till date, the revisionist is not an accused in this case.
After advancing some arguments, learned counsel for the revisionist submits that the revisionist may be allowed to withdraw this criminal revision at this stage.
Learned A.G.A. representing the State has no objection to such prayer of learned counsel for the revisionist.
In view of the statement made by Mr. M.R. Gupta, learned counsel for the revisionist at the bar, the instant criminal revision is dismissed as not withdrawn/not pressed.
