Hon'ble Ajai Kumar Srivastava-I,J.
1. Heard Sri Sandeep Kumar, learned counsel for the revisionist, learned A.G.A. for the State and Sri Narvind Kumar Singh, Advocate, who has put in appearance on behalf of opposite party No.2 by filing his vakalatnama in Court today, which is taken on record.
2. On 23.10.2024, this Court has passed the following order :-
"Heard learned counsel for the revisionist and learned A.G.A. for the State.
Notice on behalf of opposite party no.1 has been accepted by the office of learned A.G.A.
Issue notice to the opposite party no.2, returnable at an early date.
Steps be taken within a week.
List this case on 17.12.2024 , on which date, the revisionist and opposite party no.2 shall appear in person before this Court to explore possibility of settlement of their dispute amicably through the process of mediation.
It is made clear that no interim order is operating in this matter."
3. Pursuant to aforesaid order dated 23.10.2024, the revisionist and opposite party No.2 have appeared in person.
4. The opposite party No.2 has expressed her willingness to undergo process of mediation provided some provision is made so that she may not starve as she is not getting any amount of maintenance from the revisionist for the last so many months.
5. It has been volunteered on behalf of the revisionist that having regard to his poor financial condition, he can deposit an amount of Rs.40,000/- (rupees fourty thousand) by 13.01.2025.
6. In aforesaid view of the matter, list this matter again in
the week commencing 20.01.2025 alongwith receipt of deposit of aforesaid amount so that the order referring this matter to the Mediation Centre may be passed.
7. It is clarified that the revisionist and opposite party No.2 need not appear in person on the next date of listing.
8. It is made clear that there is no interim order operating in this matter.
9. When the case is listed next, the name of Sri Narvind Kumar Singh, Advocate shall be shown in the cause list as learned counsel for opposite party No.2.
