Supplementary affidavit filed today by the learned counsel for the petitioner and instruction produced by the learned A.G.A. is taken on record.

"On 8.1.2023, we had passed the following order:-

By means of this petition, the petitioner has sought quashing of F.I.R. dated 06.11.2023 bearing Case Crime No.0403/2023 for the offence under Section-376 I.P.C. registered at Police Station-Kunda, DistrictPratapgarh.

Let the petitioner redact the name and details of the victim. The Office shall also redact the name and details of the victim in its records including the computer records wherever it occurs. The affidavit filed in support of the writ petition and other documents disclosing the identity of the victim shall be kept in sealed cover and petitioner shall file fresh document/ affidavit redacting the name and details of the victim, if any, by the next date.

Let learned A.G.A. seek instructions on the question as to whether when the alleged crime being committed, certain police personnel had reached the spot and caught the petitioner red handed. What is their version in the matter if their statements have been recorded as the case of the petitioner is of malicious and false implication.

In view of the statement of the police personnel recorded by the Investigating Officer, prima facie, the case for interference is made out, in view of the averments made in the writ petition, specially paragraph no. 8 etc.

Let notice be issued to opposite party no.4.

Let the pleadings be exchanged within eight weeks.

List thereafter.

Considering the submissions made, it is provided that the petitioner shall not be arrested on the basis of the impugned First Information Report, unless there is sufficient and credible evidence is available against him. The petitioner shall, however, cooperate in the investigation and get his statement recorded before the Investigating Officer as and when he is called. If he does not do so then it can be made a ground for seeking vacation of this interim order.
