Heard learned counsel for the petitioner and learned A,G.A. for the State and perused the material available on record.
By means of the instant petition, learned counsel for the petitioner submits that petitioner has falsely been implicated in the FIR dated 25.04.2024 registered as Case Crime No.0091 of 2024, under Section 2(b)(i), 3(1) of U.P. Gangster and Anti-Social Activities (Prevention) Act, 1986 (in short Gangsters Act).
The submission of the petitioner is that petitioner is a butcher by profession and about a year's ago an FIR bearing No.66 of 2023 was lodged against the petitioner and from whose custody allegedly a goat was recovered.
The petitioner was enlarged on bail in the said FIR No.66 of 2023 by means of order dated 31.03.2023 passed by the Sessions Court, however in the instant FIR Sections of Gangster Act has been leveled against the petitioner. There is no material on record to substantiate that any case of gangster activity is made out against the petitioner, even the ingredients of Section 2(b)(i) of Gangsters Act is not made out or prima facie attracted.
