Heard learned counsel for the petitioners, learned AGA and perused the record.
The petitioners seek issuance of a writ in the nature of certiorari for quashing of the First Information Report dated 03.04.2024 bearing Case Crime No.0070 of 2024 under Sections 420, 467, 468, 471, 504, 506, 120-B IPC, Police Station- Baldirai District- Sultanpur.
Contents of FIR shows that in the earlier FIR bearing FIR/Case Crime No.0398/2020 under Sections 419, 420, 406, 352, 504 IPC, Final Report has been submitted by the Investigating Officer and in the said a case, petitioner No.6 to 8 filed false affidavit, same is already under consideration in the protest petition filed by the informant.
Sri Suresh Kumar Pandey, Advocate informs that he has filed his Vakalatnama in Registry for respondent No.4. He prays for and is granted a weeks' time to file counter affidavit.
Three days time is granted for filing rejoinder affidavit.
List this case in the week commencing 29.04.2024.
Till the next date of listing, petitioners shall not be arrested in pursuance to the First Information Report dated 03.04.2024 bearing Case Crime No.0070 of 2024 under Sections 420, 467, 468, 471, 504, 506, 120-B IPC, Police Station- Baldirai District- Sultanpur.
